1. Agreement to Terms

Welcome to VTwinBikers. These Terms of Service ("Terms") govern your access to and use of the VTwinBikers website, products, and services (collectively, the "Site"). By accessing or using our Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

VTwinBikers reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Site following any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to make a purchase or create an account on VTwinBikers. By using the Site, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract.

3. Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activities under your account

VTwinBikers is not liable for any loss or damage arising from your failure to safeguard your account credentials.

4. Products & Pricing

Product Information

We make every effort to display accurate product descriptions, specifications, images, and fitment data. However, we do not warrant that product descriptions, pricing, or other content on the Site are error-free, complete, or current. Colors, finishes, and product appearances may vary slightly from images shown.

Fitment Responsibility

It is the customer's responsibility to verify that parts are compatible with their motorcycle's year, make, model, and configuration before placing an order. While we provide fitment guides and product information, VTwinBikers does not guarantee fitment and is not responsible for parts ordered incorrectly.

Pricing & Errors

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. In the event of a pricing error, typographical mistake, or inventory issue, VTwinBikers reserves the right to:

  • Cancel orders placed at the incorrect price
  • Refuse or limit quantities
  • Correct any errors and notify the customer

We will issue a full refund for any canceled order.

5. Orders & Payment

Order Acceptance

Submission of an order constitutes an offer to purchase. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to suspected fraud, inventory shortages, or pricing errors.

Payment Methods

We accept major credit cards, debit cards, and other payment methods displayed at checkout. By providing payment information, you represent that you are authorized to use the payment method and authorize VTwinBikers to charge the full order amount.

Sales Tax

Applicable sales tax will be calculated and charged based on the shipping destination in accordance with state and local tax laws.

6. Shipping & Delivery

Shipping terms, processing times, and delivery details are governed by our Shipping Policy, which is incorporated into these Terms by reference.

7. Returns & Refunds

Returns, exchanges, and refunds are governed by our Return Policy. All return requests must be submitted in accordance with the timelines and conditions outlined therein.

8. Warranties & Disclaimers

Manufacturer Warranties

Products sold by VTwinBikers may carry manufacturer warranties. Warranty claims must be processed directly with the manufacturer in accordance with their terms. VTwinBikers will assist customers in initiating warranty claims when possible.

Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

VTwinBikers does not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

9. Use of Products & Assumption of Risk

Motorcycle parts and accessories sold on this Site are intended for use by qualified individuals. Many products are designed for off-road or racing use only and may not be legal for street or highway use in all jurisdictions.

By purchasing from VTwinBikers, you acknowledge and agree that:

  • You assume all risks associated with the installation, modification, and use of products purchased
  • Motorcycle modification can affect vehicle performance, safety, and legality
  • You are responsible for compliance with all federal, state, and local laws, including EPA, DOT, CARB, and noise regulations
  • Professional installation by a qualified mechanic is recommended for performance and safety-critical components
  • VTwinBikers is not responsible for injuries, damages, or losses resulting from improper installation, misuse, or use of products contrary to manufacturer instructions

Racing and competition use is at your own risk. Motorsports are inherently dangerous.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VTWINBIKERS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your use of or inability to use the Site or products
  • Unauthorized access to or alteration of your transmissions or data
  • Statements or conduct of any third party on the Site
  • Any other matter relating to the Site or products

VTWINBIKERS' TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless VTwinBikers, its officers, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your misuse of products purchased from the Site
  • Your violation of any law or third-party rights
  • Any content you submit to the Site

12. Intellectual Property

All content on the Site, including text, graphics, logos, images, videos, product descriptions, the VTwinBikers and KOTB Race branding, and software, is the property of VTwinBikers or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content without prior written permission from VTwinBikers.

13. User-Generated Content

By submitting reviews, comments, photos, videos, or other content to the Site, you grant VTwinBikers a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, and distribute such content in any media.

You represent that any content you submit:

  • Is your original work and does not infringe on third-party rights
  • Does not contain unlawful, defamatory, obscene, or harmful material
  • Complies with all applicable laws

VTwinBikers reserves the right to remove any user content at our sole discretion.

14. Prohibited Uses

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the Site, accounts, or systems
  • Use automated tools (bots, scrapers, crawlers) to access or extract data
  • Interfere with or disrupt the Site's operation or security
  • Resell products purchased from VTwinBikers without written authorization
  • Engage in fraudulent transactions or chargebacks

Violation may result in account termination, order cancellation, and legal action.

15. Third-Party Links & Services

The Site may contain links to third-party websites or services. VTwinBikers is not responsible for the content, policies, or practices of any third-party sites. Access to third-party sites is at your own risk.

16. Termination

VTwinBikers reserves the right to suspend or terminate your account or access to the Site at any time, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Site immediately ceases.

17. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved as follows:

Informal Resolution

Before filing any formal claim, you agree to first attempt to resolve the dispute informally by contacting us at sales@vtwinbikers.com.

Binding Arbitration

Any unresolved dispute shall be settled by binding arbitration administered in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.

Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in a class action, class arbitration, or other representative proceeding.

Jurisdiction

For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and VTwinBikers regarding your use of the Site and supersede any prior agreements.
